1. Scope
This AUP applies to all use of LO Marketing Tools and is incorporated into the Terms of Service.
2. Customer Responsibility
Customer is solely responsible for determining whether it may lawfully contact each recipient, selecting the channel, establishing required consent, and complying with all laws and provider requirements. LO Marketing Tools does not provide or transfer recipient consent and does not certify any contact as eligible for outreach.
3. Consent, Permission, and Suppression
You must obtain, document, and maintain any required consent before sending. Where written consent is required, maintain evidence showing who consented, to whom consent was given, what they agreed to receive, the channel/purpose, and when/how consent was obtained. Honor opt-outs, revocations, unsubscribe and do-not-contact requests. You may not re-add a suppressed recipient merely by importing the recipient again or switching providers, numbers, domains, accounts, or campaigns.
4. Prohibited Messaging and Abuse
- Spam, unsolicited bulk messages, or unwanted communications prohibited by law or provider policy.
- Promotional SMS or other messages without the level of consent required by law/provider.
- Messaging after consent is revoked or a recipient opts out, except a legally permitted confirmation.
- Harassment, threats, repeated unwanted contact, fraud, phishing, impersonation, spoofing, or materially misleading communications.
- False/misleading headers, routing, caller ID, sender ID, domains, subject lines, or identity.
- Evasion of spam, carrier, provider, fraud, deliverability, registration, rate-limit, trust-and-safety, or enforcement systems.
- Snowshoeing or distributing similar traffic across numbers, domains, accounts, IPs, or providers to avoid detection.
- Disabling or circumventing unsubscribe, STOP, suppression, complaint, or abuse mechanisms.
- Routing through another provider after the same traffic/campaign has been prohibited.
- Any communication violating law, carrier rules, industry requirements, or a Third-Party Service agreement.
5. Commercial Email
You must comply with CAN-SPAM and other applicable law, including accurate sender/routing information, non-deceptive subject lines, required advertising disclosures where applicable, a valid physical postal address, a clear opt-out method, and timely honoring of opt-outs. You are responsible for determining whether a message is commercial, transactional, or otherwise regulated.
6. SMS, MMS, RCS, and Messaging
You must comply with the TCPA, applicable FCC rules, state law, carrier requirements, CTIA guidance where applicable, and your provider's rules. Use the level and form of consent required for the particular communication. Promotional messaging may require prior express written consent. Identify the sender where required, provide required opt-out instructions, process standard opt-out keywords and other legally valid revocations, retain consent evidence, and stop future messages when consent is revoked except where law permits a limited confirmation.
7. Contact Lists and Data Sources
You are responsible for the origin, accuracy, licensing, permissions, and lawful use of every list or record you upload, import, select, enrich, or use. You may not use scraped, harvested, purchased, rented, shared, or third-party lists in a manner that violates law, consent requirements, or provider rules. A list provider's claim that data is “compliant” does not relieve you of your obligations.
8. Identity and Sender Transparency
You may not impersonate another person or organization. Accurately identify the party on whose behalf a communication is sent and include required contact, disclosure, and sender information.
9. AI and Automation
You remain responsible for AI-generated or automated content and actions. Do not instruct AI or automation to bypass opt-outs, fabricate consent, conceal identity, evade provider enforcement, or make false compliance claims.
10. Security and Platform Integrity
You may not probe, scan, attack, overload, introduce malware, access accounts without authorization, improperly share credentials, interfere with security controls, or use the Services for credential theft, phishing, or malicious activity.
11. Unlawful and High-Risk Content
You may not use the Services for unlawful activity, fraud, exploitation, illegal discrimination, infringement, malicious software, or communications creating an unreasonable risk of harm. We may impose additional restrictions for high-risk industries, jurisdictions, content, or use cases.
12. Enforcement
We may investigate suspected violations and warn, restrict, throttle, block, quarantine, suspend, or terminate access without prior notice when reasonably necessary. Our enforcement is not a substitute for Customer's compliance program, and failure to detect a violation is not approval.
13. Reporting Abuse
Report suspected abuse to [ABUSE EMAIL] with enough information to investigate, such as sender, date/time, recipient, and campaign/message details.
